TERMS OF SERVICE
Service Contract
Wherever “We,” “Us,” or “Our” is mentioned, it refers to Domainorbis or any entity acting on Domainorbis’s behalf. “You,” “Your,” “Reseller,” “Purchaser,” or “Client” refers to the individual or entity purchasing or utilizing our services. “Member” refers to the customer of our services and any party acting on the customer’s instructions. “Registrant” is the individual applying for a domain name or any party acting on their instructions. “Registry” refers to the applicable domain name registry. “Server” refers to the computer server system in connection with the provision of our services. “Website” refers to the space allocated by us on the server, which you can use as your domain on the Internet. “TOS” refers to this Service Agreement. Domainorbis reserves the right to modify this policy at any time, effective upon posting the amendment on this URL: https://domainorbis.com/terms-conditions. By using any part of Domainorbis’s services, you agree to this Service Agreement.
This document is the agreement between you and Domainorbis.
Delivery of Services
Upon successful payment, you will receive an automated receipt from our system. Please print and retain a copy of this receipt for future reference. Your unique customer username will be listed on this receipt, and you should use this username for any inquiries to Domainorbis. Please note that we aim to deliver all services promptly after sign-up completion. If we are unable to meet this, you will be informed via email or phone. Payments will be deducted once services are delivered. All orders are delivered electronically via email. For questions about your order, please contact us at support@domainorbis.com.
Our operating hours are 365 days a year, 24/7. Typically, we will respond within 1 hour of receiving your inquiry. The services available on this website are subject to export and import regulations. Please check the policies in your country to determine if these products are permitted for import. We will not add any additional charges for customers using VISA and MasterCard card schemes. The final price will remain the same, regardless of the payment method.
Refund Policy
If you’re dissatisfied with any aspect of our service, please contact our support department, and we will try to resolve the issue. If the problem cannot be resolved and you’re still dissatisfied, you are entitled to a refund within 30 days. No refunds will be provided after 30 days.
Refunds are not available for domain names (.COM, .NET, .ORG), SSL certificates, domain transfer fees, domain transfer-out charges, or any other products or services offered through Domainorbis or third-party agencies. VPS and Dedicated servers are non-refundable under any circumstances. Refunds will not be issued if we terminate your hosting or other services due to a violation of our Acceptable Use Policy or Terms and Conditions, except where specified. This does not affect your statutory rights.
Account credits cannot be refunded and must be used for purchases and renewals. Setup fees are non-refundable. Accounts purchased under promotional offers, with or without a promo code, are excluded from the 30-day money-back guarantee. Any excess funds sent to Domainorbis will be credited to your account but cannot be refunded.
SLA Conditions
If your service drops below 99.9% uptime in any given month, you will receive a free month of service as compensation. This must be claimed within 7 days of our monitoring service detecting the issue. Any planned maintenance is excluded from this guarantee and will be disregarded. Dedicated servers currently do not have an SLA. Uptime levels are calculated based on our status page and monitoring systems.
Free Domain Conditions
A free domain will be registered for you with a premium hosting package when you pay annually. Only one free domain will be registered per account. The hosting period lasts for 3 months, after which you are free to transfer the domain to another host if desired. The domain will not be transferable to another customer during this time. If you cancel hosting before the 3-month paid period, Domainorbis reserves the right to cancel or resell your domain. This offer applies to.COM, .NET, and. BIZ domain names only.
Affiliates
Affiliates must not mask, hide, or modify the affiliate link. It should be used as displayed in the customer area. Affiliates may not spam or promote the link on websites that violate the platform’s guidelines. Any violation will result in the affiliate link being removed.
Web Hosting
These Terms of Service and Acceptable Use Policies (“Terms and Policies”) are essential for your relationship with Domainorbis. By using your Domainorbis account, you agree to these Terms and Policies.
General Terms and Policies
The service is provided to authorized individuals or organizations (referred to as “Subscriber” or “You”). Any use of the service is subject to these Terms and Policies. If you do not agree to be bound by these Terms and Policies, you must immediately cancel your account and cease using the service.
Prices and Charges
Domainorbis provides the use of cPanel and control panels at no additional charge. However, if we incur costs due to misuse or abuse on your part, we reserve the right to pass those costs to you. The service is provided for as long as you wish to use it, but we reserve the right to terminate the service if you violate the terms of use.
Backups
Domainorbis takes regular backups, but these are not guaranteed. Backups are solely for our internal use in case of server failure. We recommend clients back up their data to their personal computers or storage servers. Clients are responsible for their data. Backup recovery is subject to a $10 one-time fee.
Suspended or terminated account backups can be retrieved for a $20 one-time charge, depending on availability. We retain terminated account backups for up to 13 days.
Grounds for Suspension and Termination
You agree to comply with these Terms and Policies. Any violation of these Terms or related policies may result in suspension or termination of your account. We reserve the right to suspend or terminate your account upon the occurrence of any of the following:
- Violation of any applicable law, court order, or statute.
- Hosting adult content or engaging in spamming.
- Abusing or violating the privacy or property rights of others.
- Engaging in unlawful activities such as phishing, pirated software, and distributing copyrighted material.
- Using the service to attempt to damage security or perform unauthorized activities.
Security
You agree not to attempt unauthorized access to the service. If you notice any security breaches or unauthorized use of your account, you must notify Domainorbis immediately.
Intellectual Property
Domainorbis is not responsible for evaluating messages, files, or materials available through the service. Any complaints related to copyright infringement can be sent to abuse@domainorbis.com.
Liability
Use of the service is at your own risk. Domainorbis is not liable for any damages, losses, or issues arising from your use of third-party materials, software, or services. You agree to indemnify and hold Domainorbis harmless from any claims or damages resulting from your actions.
Warranty
Domainorbis provides the service “as is” and does not make any warranties, either express or implied, regarding its functionality, accuracy, or performance.
Resource Usage
Excessive resource usage such as running high CPU-consuming processes or using the service as a file storage system may lead to suspension or throttling. Additional charges apply for resource overages.
VPS Usage
Clients must not run CPU-intensive processes that exceed specified limits. Violation may result in suspension or shutdown of services.
Content
You are responsible for ensuring that the content you host is appropriate and complies with the service’s guidelines. Domainorbis does not take responsibility for objectionable materials.
Disputes and Governing Law
Any disputes with Domainorbis will be settled through binding arbitration, subject to Bangladeshi and international law.
Cancellation Procedure
To cancel services, submit a request via your customer area. Cancellations must be requested before the invoice due date. Dedicated server cancellations require a 15-day notice before the renewal date.
Resellers
Resellers can offer services to their clients but are prohibited from hosting free accounts.
Transfer Policy
Free transfers apply for cPanel to cPanel transfers. Other transfers may incur a fee of $10. Transfers for VPS or dedicated servers are free.
Discount Vouchers
Only one voucher may be used per transaction. If the order amount is lower than the voucher value, the difference is forfeited.
Account Payments
Overdue accounts will face suspension, late fees, and termination if the invoice is not settled. VPS and dedicated servers will be suspended immediately if payments are overdue.
Amendments
Domainorbis reserves the right to amend these Terms and Policies at any time. Continued use of the service will indicate acceptance of the updated terms.
